Commentary from Tunyan Law regarding the Temporary Suspension of Issuance of Immigrant Visas to Citizens of Certain Countries

At this stage, only a suspension of the issuance of immigrant visas by the U.S. consular service has been established. These visas include all visa categories that serve as a basis for obtaining a green card upon arrival in the United States.

As stated in the official notice, the processing of all immigrant petitions and the conducting of interviews at consular offices continue under normal procedures. However, significant delays are possible specifically at the visa issuance stage, even in cases where the consular interview is successfully completed.

It is likely that additional requirements regarding the financial sufficiency of individuals receiving immigrant visas will be introduced in the near future. The application of stricter medical requirements for immigrants is also being discussed.

It is important to note that this suspension does not affect nonimmigrant visas in any way, such as tourist, student, trade, and work visas that do not provide for obtaining a green card.

It should also be taken into account that these restrictions do not in any way affect the obtaining of a green card through adjustment of status for individuals who are physically present in the United States, who entered the United States lawfully, or who have other lawful grounds for obtaining a green card, for example: an approved immigrant petition or an approved asylum case.

We recommend continuing to file family reunification petitions, as well as all other immigrant petitions, in the ordinary manner, since their processing may take from several months to several years. For individuals who have an approved immigrant petition and a valid visa for lawful entry into the United States, we recommend consulting with an immigration attorney regarding the possibility of adjustment of status and obtaining a green card within the United States.

It is expected that new rules and requirements will be published in the near future, and by the time your petition interview is scheduled, the situation should already be clarified.
